Comprehensive Standards 3.2.2.2

Summary

Cape Fear Community College (CFCC) demonstrates compliance with this comprehensive standard by providing evidence that the legal authority and operational control are clearly defined in the North Carolina General Statutes, the Powers and Duties of the Board of Trustees, and the Bylaws of the CFCC Board of Trustees. The Board has delegated fiscal authority to the College President who keeps the Board of Trustees apprised on fiscal matters.

Narrative

The legal authority and operating control of the College are noted in the powers and duties of the Cape Fear Community College Board of Trustees, as defined in North Carolina General Statutes, Chapter 115D-20 and as noted in the Board’s Operation Manual (Powers and Duties of the Board of Trustees pg 5). The Board has delegated the responsibility for preparing the annual budgets to the College President who then submits the budget to them for formal adoption. In addition, the Board delegated authority to enable the President to make line item transfers where needed and to inform the Finance Committee of those transfers (By-Laws pg 5). The College President has full authority and responsibility for the operation of the College under the rules and policies stated in the Bylaws of the CFCC Board of Trustees, State Board of Community Colleges, and as described in his job description (President’s Job Description).

The CFCC Board of Trustees formally adopts the Budget Resolution each fiscal year (September 23, 2004 Board Minutes pg 4) as required by North Carolina General Statues, Chapter 115D.54 under Article 4A and 115D.56 (NCGS 115D.54 and NCGS 115D.56). The Board receives financial reports at their bimonthly meetings (March 25, 2004 Board Minutes pg 5) plus receive the annual audit report issued by the Office of the State Auditor (March 27, 2003 Board Minutes pg 5) and the equipment inventory audit issued by the North Carolina Community College System (May 26, 2005 Board Minutes pg 6).

The College is fiscally stable as demonstrated in Core Requirement 2.11.
